Needles, CA: Summary and voting results from the Needles City Council and Needles Public Utility Authority Meeting.

A Needles City Council and Needles Public Utility Authority Meeting was held on Tuesday, May 9th, 2017 inside the Needles City Council Chambers in Needles, California.

Needles City Council Member Robert Richardson M.D. was participating via teleconference from Lancaster, California, and Needles City Council Member Louise Evans had an excused absence.

** Needles Vice Mayor Jeff Williams was back after having medical issues, and thanked everybody for their messages and prayers of support and good health. **

– Agenda Item A: Conference with Legal Counsel — Anticipated Litigation pursuant to Government Code Section 54956.9{d){4). {Two potential cases: consideration of initiation of litigation against: 1) Days Inn and Wise Hospitality, LLC; 2) River Road Resort et.al.)

– Agenda Item A: Needles City Attorney John Pinkney reports that there was reportable action taken as to both items (1 and 2) on Agenda Item A. There was a motion to initiate a lawsuit for collection of past due amounts owed under the City’s Transient Occupancy Tax Ordinance against Days Inn and Wise Hospitality, LLC; and River Road Resort et. al. Members of the Needles City Council unanimously voted to approve the motion.

Barbara Beard spoke during Public Appearance about Needles Code Enforcement regarding 3 properties in her neighborhood that are in bad condition and possible fire hazard, and the City of Needles’ website that was to show all of the issued citations.

Resident along California Avenue spoke during Public Appearance about 2 issues; the dirty conditions inside a pedestrian tunnel that goes under Interstate 40, and the need of better signage for their street so that semi trucks know that their street is not a through street; concerns that a semi trucks could hit a fire hydrant or light pole when they’re backing up and making a u-turn.

Regarding the pedestrian tunnel, lighting inside the pedestrian tunnel is always out, graffiti lays along the walls, trash littered along the walkway, and sometimes feces is found on the ground and on the side of the walls. The pedestrian tunnel connects California Avenue to West Broadway near Walnut Street in Needles, California. The pedestrian tunnel has a camera near by, but unknown who’s operating the camera; the City of Needles or the San Bernardino County Sheriff’s Department.

– Agenda Item #1: A representative from San Bernardino County Fire Department will report on the recent hotel fire.

Representatives with the San Bernardino County Fire Department gave a report on what they said happened at the Americas Best Value Inn Fire in Needles, California on Saturday, April 15th, 2017.

A representative from the San Bernardino County Fire Department talked about when they got the call to the fire and how “immediately” got on the radio and responding to the fire, despite reports from witnesses, including the postal worker who alerted firefighters across the street, that the fire department took over 10 minutes to response.

The representative from the San Bernardino County Fire Department also said that other then the postal worker and 2 passer byers calling in the fire, there were no calls made to 911 from the hotel.

The representative from the San Bernardino County Fire Department also said that Fire Station 32 was the first to arrive to the hotel fire, responding at at 8:28am PT minutes after receiving the report from the postal worker at 8:23am PT; a 5 minute response time.

The representative from the San Bernardino County Fire Department said that they called in other resources in from the area as part of the mutual aid. 

Clayton Hazlewood said that people have been seeing the San Bernardino County Fire Department’s fire engine at a Safeway grocery store in Fort Mohave, Arizona and Clayton Hazlewood asked what’s the closes response the community can get if something happens and can those other things like getting groceries be done rather then the fire engine.

San Bernardino County Fire Department’s Thomas Marshall said that we try to limit the number of times they go during the week – they do, you may see them there twice a week, not seeing them in their barracks, and breaking up the crew, you break up the crew’s strength.

Clayton Hazlewood said that you have a lot of people here (Needles, California) paying $170.00 a year on their property taxes and wants to make sure they have a fire engine there for them. 

Needles City Council Member Shawn Gudmundson asked Thomas Marshall if that can be done by a clerk or somebody else, getting groceries for the fire station instead of the crew.

Thomas Marshall said we don’t, adding that the 3 are here (firefighters) and they bring their own food with them, its when you’re there and someone says ‘Hay, somebody forgot to bring in chicken’.

Clayton Hazlewood asked Thomas Marshall if there’s another vehicle that can be use, but Thomas Marshall repeated that it would break up the crew and you wouldn’t have 3 guys (firefighters) available – there would only be 2 guys (firefighters) and 2 guys can’t put out a fire.

– Agenda Item #2: NPUA / COUNCIL: Approve a drawdown of the Water Asset Replacement Fund for repair/ replacement of fire hydrants at a cost not to exceed $16,000 through the end of the current budget year.

Members of the Needles Public Utility Authority and the Needles City Council unanimously voted to approve a drawdown of the Water Asset Replacement Fund for repair/ replacement of fire hydrants at a cost not to exceed $16,000 through the end of the current budget year.

The Mayor or any member of the Needles City Council may pull an item from the Consent Calendar for discussion. Prior to Needles City Council action, a member of the public may address the Needles City Council on matters Scheduled on the Consent Calendar. A 3 minute time limit per person applies. Recommended Action: Approve items #3 through #5 on the Consent Calendar by affirmative roll call vote.

– Agenda Item #3: Approve the warrants register through May 9, 2017.

– Agenda Item #4: Authorize the Mayor to sign a letter of opposition to the Governor’s Trailer Bill for implementing the Adult Use of Marijuana Act (Prop 64) and deliver it to state legislators.

– Agenda Item #5: Concur with the League of California Cities and the City Clerks Association of California (C.C.A.C.) opposition to AB1479 (Public Records Requests, Supervisor of Records and Fines) and authorize the Mayor to send a letter in opposition to the California State Assembly.

Members of the Needles City Council unanimously voted to approve Agenda Items 3-4 and to pull Agenda Item #5 for discussion.

Regarding Agenda Item #5: members of the Needles City Council unanimously voted 3 to 2 to approve concur with the League of California Cities and the City Clerks Association of California (C.C.A.C.) opposition to AB1479 (Public Records Requests, Supervisor of Records and Fines) and authorize the Mayor to send a letter in opposition to the California State Assembly. Needles City Council Member Shawn Gudmundson and Needles City Council Member Clayton Hazlewood voted “No” on Agenda Item #5.
