Breaking News!!: Phoenix, AZ: Former Maricopa County Sheriff Joe Arpaio found guilty of criminal contempt.

Breaking News!!: Phoenix, AZ: Former Maricopa County Sheriff Joe Arpaio found guilty of criminal contempt.

A United States District Judge on Monday, July 31st, 2017 has found former Maricopa County Sheriff Joe Arpaio guilty of criminal contempt.

United States District Judge Susan Bolton found the former Maricopa County Sheriff, 85 year old Joe Arpaio, with misdemeanor contempt of court for allegedly defying a judge’s 2011 order to stop traffic patrols that targeted immigrants.

His trial started in June 2017 and during the trial, prosecutors allegedly told the judge that Joe Arpaio blew off a court order in 2011 to stop picking up suspected illegal immigrants, and handing them over to ICE and Border Patrol, where there were no state charges against them.

Prosecutors claim Joe Arpaio did this because he was running for reelection in 2012, and that Joe Arpaio allegedly used his defiance to raise millions of dollars and brag about it to the media.

Joe Arpaio’s lawyers argued that he didn’t intend to break the law.

** Picture from NBC affiliate KPNX Channel 12: **

The former Maricopa County Sheriff, self-named “America’s toughest sheriff,” was known for, among other things, cracking down on illegal immigration and using controversial “crime suppression sweeps” to round up those suspected of being in the United States illegally which those operations, which went on for years, are what landed him in court.

The former Maricopa County Sheriff was voted out of office in November 2016 after serving 6 terms.

Joe Arpaio’s lawyer Jack Wilenchik said they will be appealing the verdict to get a jury trial and released the following written statement,”Today, Judge Susan Bolton violated the United States Constitution by issuing her verdict without even reading it to the Defendant in public court. Her verdict is contrary to what every single witness testified in the case. Arpaio believes that a jury would have found in his favor, and that it will. Judge Bolton found that an order by her fellow Judge G. Murray Snow, who is in the same building and sits on the same Arizona court, clearly said something that it did not even say: that the MCSO was prohibited from turning illegal aliens over to Border Patrol or ICE. Every witness in the case testified that the order was not clear, even though Judge Bolton and her fellow judge say so. Numerous law enforcement agencies also continue to do this. In fact, the DOJ now goes after agencies that refuse to do this.” It’s not clear when the appeal will be filed. “Joe Arpaio is in this for the long haul, and he will continue his fight to vindicate himself, to prove his innocence, and to protect the public,”

The Maricopa County Sheriff’s Office also released the written statement saying, “Although the election in November was a statement by this community to put an end to the prior administration’s practices, the verdict today by U.S. District Court Judge Susan Bolton is a conclusion to the disservice and distractions caused by former Sheriff Joe Arpaio. We have a great respect for the justice system and the process and responsibility to carry out justice. As for this office, we remain steadfast in our efforts to serve the needs of public safety, to improve quality of relations with the community and to ensure that the men and women of this organization have the utmost respect for the law and the authority for which we are empowered.”

Joe Arpaio will be sentenced at 10:00am MST on Thursday, October 5th, 2017.

News Alert!!: Mohave County, AZ: New watercraft restrictions being proposed for the Havasu National Wildlife Refuge.

News Alert!!: Mohave County, AZ: New watercraft restrictions being proposed for the Havasu National Wildlife Refuge.

The United States Fish and Wildlife Service is again proposing new series of no wake and restricted zones throughout the backwaters of the Havasu National Wildlife Refuge in Mohave County, Arizona just a year after a controversial watercraft restriction, that proposed restrictions on recreational boating in the Havasu National Wildlife Refuge, failed to get any support and was withdrawn.

** Map (Pictured Above) of new watercraft restriction being proposed from the United States Fish and Wildlife Service: **

Under the new proposal, waters inaccessible to boaters will be designated as backwaters, prohibiting boaters from launching watercraft or operating personal watercraft in the Havasu National Wildlife Refuge areas, including Beal Lake, Pintail Slough, Lost Lake and Topock Bay.

The stipulation would prohibit towed recreational activities in these areas and prohibit kite-boarding and hydro-flight equipment in waters south of Interstate 40 near Topock, Arizona.

The United States Fish and Wildlife Service’s proposal would also remove restrictions on air-cooled outboard engines, while prohibiting the use of hovercraft within refuge waters.

** A draft CD of the new proposal was released to the public and can be viewed at the following website address: **

https://www.fws.gov/uploadedFiles/HavasuBoatingCD-Draft-July_2017.pdf

The public comment period is for 30 days, beginning Tuesday, August 1st, 2017 through Wednesday, August 30th, 2017.

To be part of the record, comments must be in writing to:

U.S. Fish and Wildlife Service, Havasu National Wildlife Refuge,

Attn: Draft Recreational Boating CD Comments

317 Mesquite Avenue

Needles, California, 92363.

You can also email the United States Fish and Wildlife Service with your comments to: havasu_comments@fws.gov

In addition comments must be received on, or postmarked by, Wednesday, August 30th, 2017.

In 2016, a previous draft CD was released of a proposal watercraft restriction by the United States Fish and Wildlife Service resulted in public outcry against stricter proposals.

Crowd of people (Pictured Above) filled up the conference hall at the Avi Resort and Casino in Laughlin, Nevada on Tuesday, May 3rd, 2016 to speak out against the United States Fish and Wildlife Service proposed boating restrictions, including from local city, county, and state officials, including Needles Mayor Edward T. Paget, San Bernardino County Supervisors Robert Lovingood, Mohave County Supervisor Buster Johnson, United States Congressman Paul Cook, and United States Senators McCain and Flake.

United States Senators John McCain and Jeff Flake, both Arizona Republicans, filed an amendment to the Transportation, Housing and Urban Development Appropriations Bill designed to drive the United States Fish and Wildlife Service to drop proposed restrictions on recreational boating at Havasu National Wildlife Refuge.

“USFWS’s proposal to restrict recreational boating near Lake Havasu could devastate small businesses throughout the region that depend on the millions of people who visit every year to enjoy boating, water skiing, and other activities on the lake. The USFWS should rethink its proposal and listen to the concerns raised by the citizens of Mohave County whose lives and livelihoods depend on outdoor recreation,” said United States Senator John McCain of Arizona.

After a lot of public outcry and extension of the comment period, the proposed boating restrictions was withdrawn.

The United States Fish and Wildlife Service is saying that these new proposed restrictions will do little to obstruct recreational boating in the Havasu National Wildlife Refuge or on the Colorado River.

The United States Fish and Wildlife Service have not said yet if there will be any public meetings for the public to address their concerns on this new proposal.

During discussion on this agenda item, the public got to speak on the matter, regarding asbestos contamination at 539 West Broadway near C Street, the old Ford dealership, in Downtown Needles, California.

A father addressed members of the Needles City Council of his concerns over the airborne asbestos contamination that test results found was inside Needles Assembly of God Church leading to the closure of the church and school.

According to Pastor Thomas Lamb of Needles Assembly of God Church, testing that was conducted inside their church by an asbestos and environmental consulting firm revealed contamination from airborne chrysotile asbestos at 358,000 structures per square centimeter.

Needles Assembly of God Church is just across the street from the old Ford dealership where clean up company were cleaning out old Southern California Gas Company (SoCal Gas) pipes that were removed from 2 construction sites in the Mojave Desert.

The father pointed to his daughter in the crowd for members of the Needles City Council to see that she was expose to the airborne asbestos contamination and wanted members of the Needles City Council to know that they want something to be done against the people who allow this to happen.

A post master for the Untied States Postal Service office, located just around the concern from the old Ford dealership, also raise their concerns of asbestos contamination and worry about their property as well as others in the surrounding area.

Pastor Thomas Lamb wants the City of Needles to hold the purported generators of the contamination responsible for the asbestos contamination.

Needles City Manager Rick Daniels had forwarded Pastor Thomas Lamb’s letter – that was presented to members of the Needles City Council at the last Needles City Council Meeting – to the permitting agencies with jurisdiction, including to the Mohave Desert Air Quality Management District, Occupational Safety and Health Administration, the Department of Toxics and Substance Control, the United States Department of Transportation, and the California Highway Patrol.

Needles City Manager Rick Daniels received a response from the Mohave Air Quality District regarding the matter which read, “Good Morning Rick – I know that my Deputy Director over Compliance, Bret Banks, has been working diligently on this issue with the complainants and keeping others involved. I believe We also have Copies of this report on samples taken by the complainant’s contractor, and we also have additional information taken by our Staff. Latest update on our end, we have provided our oversite agency, California Air Resources Board (CARB), our gathered information and background on the issue and have asked that they provide us guidance and recommendation(s), if any, that the AM should take based on the information that we have gathered. We are in the process of trying to set up further communication with CARB, but as of this moment that has not been set in stone yet. Bret and I will keep you up to date our progress. We appreciate the Cooperative and collaborative effort that you and the City of Needles are providing to try and address the issue appropriately. Sincerely, Brad Poiriez Executive Director Mojave Desert AQMD“.
