Kingman, AZ: Sentencing of a 46-year-old Kingman, Arizona man charged with trespassing after wearing a t-shirt stating, “F*** the Tax” will be sentence today.

Mervin Fried will be sentence at 2:30pm MST today at the Cerbat Justice Court located at 524 West Beale Street in Kingman, Arizona.

Supports of Mervin Fried and Free of Speech are planning to protest in front of the Mohave County Superior Court today.

Mervin Fried was found guilty and may be sentence to 30 days in prison.

Kingman, AZ: Judge sides with county in ‘F*** the Tax’ T-shirt case.

Score one for Mohave County in an ongoing battle with envelope-pushing activist Mervin Fried. The 46-year-old Kingman man has been convicted of trespassing in the Mohave County auditorium building in downtown Kingman.

Fried prevailed in a previous trial following his arrest for carrying a pitchfork into the same building in Feb., 2010. A different judge convicted Fried Wednesday, Jan. 31, for refusing to leave a meeting in progress last August while wearing a t-shirt that said “F*** the tax.”

Kingman Justice of the Peace Pro Tem Michael Slovek essentially ruled that county officials were within their right to arrest Fried for violating an ordinance prohibiting citizens from wearing clothing with profane references during board of supervisors meetings.

Fried, expecting the maximum sentence, has resigned with respect to his employer, citing jail time would take him away from his professional duties.

“The State has shown that they want to make an example of me. As my attorney pointed out at my pretrial conference, there was no plea agreement offered, which he said was unusual. He also pointed out the fact that the prosecutor was introducing himself to members of the court staff. The reason for this is that the prosecutor never tries cases in justice court – he always tries cases such as rape, murder, and people like Warren Jeffs in superior court,” Fried said. “So with this in mind, I have tendered a letter of resignation to my employer because I expect the maximum sentence. My employer needs time to find someone to train in the many computer programs we use, and also for the emergency responder and hazmat duties that I have, in addition to the supervisory responsibilities that go with my position.”

Sentencing is scheduled Feb. 23, though defense attorney Eric Engan has indicated that Fried will seek a new trial to overturn the conviction. “Slovek found him guilty, and we filed motion for new trial claiming Slovek made a legal error in his ruling.”
