Mohave Valley, AZ: Water rights transfer and fallowing program proposal became the big topic of discussion during the Mohave Valley Irrigation and Drainage District Meeting.

A Mohave Valley Irrigation and Drainage District Meeting was held on Tuesday, February 6th, 2018 at the Mohave Valley Fire Department in Mohave Valley, Arizona.

The meeting had a variety of agenda items that members of the Mohave Valley Irrigation and Drainage District discussed and voted on, including approving directing staff to secure a legislative consultant for the district and voted to re-elect Charles “Chip” Sherrill as Chairman and Perry Muscelli as Treasurer.

But what had many people in attendance was regarding the water rights transfer and fallowing program proposal related to the Central Arizona Project (C.A.P.).

ZachNews broadcast live on Facebook the Mohave Valley Irrigation and Drainage District Meeting as board members, Mohave County Officials, and some from the community discussed the water rights transfer and fallowing program proposal.

The Central Arizona Groundwater Replenishment District (C.A.G.R.D.), the operator of the Central Arizona Project (C.A.P.), wants to transfer water rights from farms in Mohave Valley, Arizona for use in the Phoenix, Arizona and Tucson, Arizona areas.

The Central Arizona Project (C.A.P.)’s governing board, the Central Arizona Groundwater Replenishment District (C.A.G.R.D.), approved in September 2017 a $34 million purchase agreement for 7 farms in the Mohave Valley, Arizona area.

The 7 farms come with about 13,900 acre feet of fourth priority and has Present Perfected Rights (P.P.R.) mainstream use water supplies.

The Central Arizona Groundwater Replenishment District (C.A.G.R.D.) is pursuing the purchase of the properties and the water rights with the intent of implementing a rotational fallowing program with farmers in the Mohave Valley Irrigation and Drainage District (M.V.I.D.D.) to generate a water supply.

The rotational fallowing program is based on a pilot voluntary program the agency created in 2013 with Yuma Mesa Irrigation and Drainage District, and would take 1 acre-foot of water which is equivalent to 326,000 gallons, enough to cover 1 acre of land with a foot of water or what the Mohave Valley Irrigation and Drainage District (M.V.I.D.D.) said is enough water to support 3 households for a year.

Concerns from the community and Mohave County Officials over the project taking of the water, including affecting community growth and creating an unhealthy dust environment that would affect farming and community due to those farms being taken out of production during the rotational fallowing program, have many people opposing the Central Arizona Project (C.A.P.) and fallowing program, and all wanting to the water to remain here in their community to be use for their community.

Trent Pike, Assistant to District 5 Mohave County Supervisor Lois Wakimoto, said to board members, “This fallowing program, I don’t believe is good at all. I don’t think we should fallow at all unless it’s for our community. You guys have no idea how much water we’re using right now. I know Mark Clark (board member who wasn’t present) had a nice presentation he did last time…” that’s when Mohave Valley Irrigation and Drainage District Chairman Charles “Chip” Sherrill interrupted saying, “We know exactly how much water we’re using.”

Trent Pike responded back saying, “No you do, you don’t know how many unregistered wells that are out there…” which Charles “Chip” Sherrill interrupted again saying, “Sure we do, we know…

Trent Pike responded back again saying, “There’s no way you Chip you know how much water we’re using, and there’s no way that you can allow W.P.I. to do a sale with C.A.P. You guys are all against it I do believe – everybody here is against it except for W.P.I. How long has W.P.I. been on this board?”

Trent Pike asked Charles “Chip” Sherrill if he knew how long has W.P.I. been on this board and he said, “5-6 years.”

Trent Pike then asked, “Who brought him to the broad – who brought this guy to the broad?” but nobody said anything.

Trent Pike continued his comments saying, “We’ve had four huge meetings, you guys know why we’re all here. The big elephant in the room, let’s talk about it. What is it – it’s because you guys want to transfer water out of this area. You’re farming for that guy (pointing at Charles “Chip” Sherrill), you know you are; you’re farming a lot Chip. This has got to stop you guys, this is ridiculous.”

Trent Pike then directly his comments to Vince Vasquez, a board member and representative for Water Property Investors (W.P.I.), the New York hedge fund proposing to sell the 7 farms to Central Arizona Project (C.A.P.).

“Vince, you need to go to your people and you need to say, ‘I’ve made a huge mistake — this is not an easy area to take water. It’s a community that cares about their area.’ Tell them you made a big mistake and you don’t want to do that, okay? And you guys, if you stand behind him, you guys are making a big mistake,” said Trent Pike.

Another man – who said he comes from Owens Valley, California – also spoke about the fallowing program and the water issue saying, “My thought of this – I come from Owens Valley and so I’m familiar of one community taking water away from another community, and what happens is it ends up in a big dust bowl. And driving in today, there was a wind blowing – we’re already have a dust bowl. And then the comments you made and a couple fellows made about… a lot less water then we would like.”

The man told members of the Mohave Valley Irrigation and Drainage District that,” it’s our water, not your (broad members), water it’s our water – you all manage it – that you would even consider partially off to anywhere… because for the potential for down the road if the drought gets worst and that some of us that live here – businesses, farms, whatever – are going to potentially be told someday well you have to close your golf course because we don’t have enough water.

Members of the Mohave Valley Irrigation and Drainage District encouraged the public to look at the Central Arizona Groundwater Replenishment District (C.A.G.R.D.) fallowing program presentation that 2 of their board members heard in a meeting with representatives from Central Arizona Groundwater Replenishment District last week.

This is just an overview of what (CAGRD) thinks a fallowing program should look like,” said Mohave Valley Irrigation and Drainage District Chairman Charles “Chip” Sherrill, adding “We did not negotiate on anything, we were there to listen.

Mohave County Administrator Mike Hendrix also spoke during the meeting and extended an invitation to each of the board members of the Mohave Valley Irrigation and Drainage District to meet with Supervisor Hildy Angius, Supervisor Lois Wakimoto, and Board of Supervisors Chairman Gary Watson to discuss the issue.

We believe there’s quite a few things that we object to that are legal issues. We have serious concerns that any attempt to try to transfer the water down to Central Arizona isn’t legal and we would challenge it with whatever means we have, as long as it takes, whatever it takes. And so, we believe since they are an elected body and my supervisors in the area, and my chairman need to open up a dialogue with them and appeal to the members to actually do the right thing,” said Mohave County Administrator Mike Hendrix.

Mohave County Supervisor Lois Wakimoto held a town hall meeting regarding proposed water sale and transfer, roundabouts on Arizona State Route 95, and health care in Arizona on Thursday, February 1st, 2018 at the Fort Mohave Elementary School in Fort Mohave, Arizona.

More than 60 people from the community attended the town hall meeting discussing as well as updating the community on the proposed water sale of rights of farm lands in Mohave Valley, Arizona by Central Arizona Project for use in the Phoenix, Arizona  and Tucson, Arizona areas, Arizona Department of Transportation’s roundabouts along Arizona State Route 95 in the Fort Mohave, Arizona area, and about health care affects affecting the Arizona, including subcontractor slow payment issues, Arizona’s Health Care Cost Containment System (A.H.C.C.C.S.), and and Health Choice Arizona.

Mohave County Supervisor Lois Wakimoto began the town hall meeting talking about the water rights sale saying, “The water issue is the biggest thing to come down the pike for Mohave County since I don’t know when. Because the water allocation that we have, the future of our community, the community that has nurtured each other and grown together is at risk with the loss of water.”

Central Arizona Project wants to transfer 5,538 acre-feet of Colorado River water outside the Mohave Valley Irrigation and Drainage District (M.V.I.D.D.) each year through a rotational fallowing program which Mohave County Supervisor Lois Wakimoto said that the lose of water would affect this community as well as surrounding communities, from Bullhead City, Arizona to Lake Havasu City, Arizona, creating an unhealthy dust environment that would affect farming and community growth in the area due to those farms being taken out of production during the rotational fallowing program.

If we lose our water, we lose our future,” said Mohave County Supervisor Lois Wakimoto adding that she encouraged residents to get more involved by contacting Arizona Gov. Doug Ducey, Arizona Department of Water Resources, and Lisa Atkins, Central Arizona Water Conservation District president.

Mohave County Supervisor Lois Wakimoto then talked about health care in Arizona and the formation of a provider committee with representatives of numerous health care specialties who will represent health care providers and improve communications with state-level health care insurance providers.

Representatives will be from the Colorado River Tri-State cities of Bullhead City, Arizona; Fort Mohave, Arizona; Mohave Valley, Arizona; Kingman, Arizona; and Lake Havasu, Arizona.

After receiving complaints from people in Mohave County, Arizona about health care providers regarding slow and no pay by Health Choice Arizona – a managed care organization and insurer contracted by the Arizona’s Health Care Cost Containment System (A.H.C.C.C.S.) for residents who are enrolled in Medicare and receiving assistance under Medicaid – Mohave County Supervisor Lois Wakimoto got involved in the issue to help address their complaints.

“We want good health care providers to stay in this area. We can’t keep quality health care in this area if they can’t get paid. The goal of the committee is to provide good lines of communication for area doctors and insurers,” said Mohave County Supervisor Lois Wakimoto.

Trent, who Mohave County Supervisor Lois Wakimoto said will be chair the committee, spoke during the town hall meeting about the committee saying, “The health committee; what we want to do basically is to provide better health care for our community and that’s through our doctors getting paid.”

Trent said that doctors are having a hard time getting paid on time and they are going elsewhere where payment is done on a timely.

Trent said that his goal is to help all of the doctors in this area get paid on a timely matter thought Arizona’s Health Care Cost Containment System (A.H.C.C.C.S.) and Health Choice Arizona and give doctors a voice on their billing.

If we can get our doctors paid on time, our doctors can afford live here the way they want to live and we can keep them here longer,” said Trent.

Mohave County Supervisor Lois Wakimoto ended the town hall meeting by talking about Arizona Department of Transportation’s roundabouts along Arizona State Route 95 in the Fort Mohave, Arizona area.

The community was updated by Mohave County Supervisor Lois Wakimoto on the Arizona Department of Transportation’s traffic study regarding the roundabouts along Arizona State Route 95, including at the Aztec Road and Camp Mohave Road interactions.

Mohave County Supervisor Lois Wakimoto said that Arizona Department of Transportation will present 2 alternatives for the intersection to Mohave County Supervisors which will include a roundabout and an upgraded signal at the Aztec Road interaction.

“ADOT finishes talking to business owners along the corridor tomorrow. I believe that they will yield to the voice of the people and are leaning against the roundabout. It’s not 100 percent sure, but I believe so,” said Mohave County Supervisor Lois Wakimoto.

Mohave County Supervisor Lois Wakimoto also said that medians will be installed as a safety measure and Arizona Department of Transportation also is willing to look at working with Bullhead City Officials on coordinating timed signals.

Arizona Department of Transportation is said to host public information meetings when the study is completed.

During public appearance regarding this agenda item, the applicant with Deco Food Service, David Deatley (Cream Shirt) and Derek Deatley (Blue Shirt), told members of the Needles City Council and the public that, “We are not relocating our business.”

This comes after concerns from the community of Deco Food Service moving their business out of Needles, California for good.

Some members of the Needles City Council are worry about existing businesses in the community selling out for medical marijuana cultivation facilities and moving their businesses to another city or to Arizona.

But the applicant with Deco Food Service said that their business has been in this community for a long time and that, “We are committed in staying in Needles” and keeping their food distribution business in Needles, California, “makes the most sense to us.”

During pass meetings which were broadcast live at ZachNews on Facebook, Deco Food Service has stated that they had no intent on leaving this community for good, and would like to grow their food distribution business in Needles, California, but the current location, on Front Street near D Street in Downtown Needles, California, restraints them from expanding their business.

The Deco food service warehouse is surrounded by 2 streets to the north and east, an alleyway to the south, and another building, Eagles Lodge #2599, to the west.

Along with no room to grow, Deco Food Service said that the current location has cracked sidewalks and driveway along Front Street that are in need of being renew.


This medical marijuana cultivation facility project will required applicants to process an encroachment permit with the City of Needles to allow for minimizing the existing sidewalk width along D Street from 5 feet to 3 feet and install landscaping along the sidewalk in front of Front Street to consist of circular/square metal tree grates for 3 trees.

The requirements came up and was unanimously voted on during public hearing at the Needles Planning Commission Meeting held on Wednesday, December 13th, 2017.

Deco Food Service states that they are working, including with the City of Needles, on finding a new location in Needles, California their food distribution business, including a site that they like along San Clemente Street.

The applicant with Deco Food Service also has stated that until a new location is found in Needles, California, they will be working out of a temporary warehouse in Fort Mohave, Arizona, but their sales and administration office, located along the 700 block of West Broadway, will remain inside that building at that location. 

Another concern that has been raised at pass meetings regarding this medical marijuana cultivation facility project was over 3 “separation issues”, occupies in the Downtown Needles, California area that are near by or down the street from the project site.

Currently, the project site is prohibited from functioning as a medical marijuana facility since it is within 1,000 ft. of the community school run by the Needles Unified School District, currently located on the corner of Front Street and F Street near Santa Fe Park.

The applicant with Deco Food Service is working with Needles Unified School District in relocating the school to a different location and is purchasing the old Desert Communities Federal Credit Union on Third Street near D Street from the Needles Elks Lodge.


A letter to the City of Needles from the Needles Unified School District, dated Wednesday, November 22nd, 2017, provides a relocation date of no later than Wednesday, February 28th, 2018.

Currently, the project site is also within 1,000 ft of a Girl Scout facility, which is located at 111 C Street.


The applicant with Deco Food Service provided a letter to the City of Needles from the President and C.E.O. of the “Girl Scouts of San Gorgonio’, dated Thursday, November 30th, 2017, indicating that they have received an offer for the purchase of the property, which will be considered by the organization at the Board of Directors Meeting in February 2018.

Currently, the project site is also 200 ft of a church, Needles Community United Methodist Fellowship, located at 111 D Street.


The applicant with Deco Food Service provided a letter to the City of Needles from Pastor, dated Thursday, November 30th, 2017, indicating the church will be vacating the site “in the very near future’.

The applicant with Deco Food Service said that they are working with Needles Community United Methodist Fellowship on finding another new location in the community.

As stated in documents from the City of Needles, the project has been conditioned so that no activity related to medical marijuana can occur at the proposed site until such time as the separation issues identified above are resolved.

Another concern that has been raised at pass meetings regarding this medical marijuana cultivation facility project has to do with the location of the project being in area the community wants to see designated as a downtown district.

Talks during pass meetings stated the need of seeing more retail businesses and restaurants in this area instead of medical marijuana cultivation facilities, but the issue has raised a debate over what is designated as downtown to the City of Needles.

City of Needles continues to discuss what is designated as being downtown, including from what street to what street makes this area be downtown, and getting a general plan for the City of Needles started.

A town hall meeting regarding Central Arizona Project water rights and transfer was held on Tuesday, December 12th, 2017 at the Mohave Valley Fire Department Station 81 in Mohave Valley, Arizona.

Over 80 people attended the town hall meeting that discussed a proposed sale to water rights to nearly 14,000 acre feet of water from farms in the Mohave Valley, Arizona to be use in the Phoenix, Arizona and Tucson, Arizona areas.

In September 2017, the Central Arizona Project’s governing board, the Central Arizona Water Conservation District, approved the $34 million purchase of 7 farms in the Mohave Valley, Arizona area that come with about 13,900 total acre-feet of water rights.

An acre foot of water is the amount needed to cover an acre of farm land with about 326,000 gallons; roughly enough water to support 2 households for a year.

The Central Arizona Project wants to transfer 5,538 acre-feet of water from the Colorado River outside the Mohave Valley Irrigation and Drainage District each year through a rotational fallowing program.

Mohave County Supervisor Lois Wakimoto talked during the town hall meeting about what Mohave County officials have been doing in opposition to the proposed sale and water transfer what the community can do to stop the proposed sale.

Mohave County Supervisor Lois Wakimoto also talked about the impacts the proposed sale and water transfer will have on the community; taking away from the needs of the community, affect farming and community growth in the area, and creating a “dust bowl” environment.

Water from the Colorado River serves the needs to nearly 40 million people and is responsible for irrigating 3.5 million acres of farmland.

Mohave County Assessor Jeanne Kentch also spoke at the town hall meeting, explaining to the residents that the county would also bear the loss of property taxes on the properties if the sale between Water Purchase Investors and Central Arizona Project goes through.

“Any government-owned property is exempt from property taxes. Everything they end up buying we will not be able to collect property taxes on,” said Mohave County Assessor Jeanne Kentch.

The public also got to speak during the town hall meeting addressing their concern over the proposed sale and water transfer, saying that this is “our water” and it should stay here in our community.

People in the crowd demand more action to be done to stop the  proposed sale and water transfer by officials.

Brad Hoover, who served as a board member of the Mohave Valley Irrigation and Drainage District until 2010, was in attendance and spoke during the town hall meeting.

“My feeling is that if the entity that bought the 7 parcels of land is in escrow for $34 million to sell 13,000 acre feet of water — well businessmen from New York are not going to buy that land if they can’t get that water for this transfer. I’m afraid they know something that we don’t know.  My fear would be we don’t have a commitment from MVIDD. If the MVIDD board has said that they’ll rely on the existing resolution, they should just re-ratify it.”

In 1989, the Mohave Valley Irrigation and Drainage District passed a resolution that prohibits the transfer of contracted water outside of the Mohave Valley Irrigation and Drainage District boundaries.

In 2008, the Mohave Valley Irrigation and Drainage District revised the resolution.

But that resolution prohibiting the transfer of contracted water outside of the Mohave Valley Irrigation and Drainage District boundaries could be changed if the board votes to do so.

The Central Arizona Project’s governing board officials are saying that the sale of the 7 farm properties is contingent on modification of that resolution and want to close the deal by mid February 2018.

Mohave County Supervisor Lois Wakimoto told the crowd that she attended a meeting Tuesday morning and heard the Central Arizona Project asked the seller of the 7 farms – Water Property Investors, LLC, a private equity fund based in New York – to extend the due diligence period during escrow.

Questions were raised over a representative who sits on the board of the Mohave Valley Irrigation and Drainage District and is a representative of the Water Purchase Investors, who’s selling the land to Central Arizona Project Groundwater Replenishment District.

Some of the people in the crowd wondered if the representative was going to casts a vote on this issue, but Mohave County Supervisor Lois Wakimoto told the crowd that this representative has abstained himself from the issue and will not cast a vote on this matter.

Members of the Mohave Valley Irrigation and Drainage District must be farmers who own land and farm a minimum of 20 acres in the district and Mohave Valley Irrigation and Drainage District registered voters.

There are at least 25 registered voters in the Mohave Valley Irrigation and Drainage District, which has 5 board members.

Mohave County Supervisor Lois Wakimoto encouraged those in attendance to keep writing letters or emailing their elected officials, stating their opposition to the proposed sale and water transfer.

“It’s the power of the people, the voice of the people and their concern about our life’s blood, our water and our community,” said Mohave County Supervisor Lois Wakimoto.

A list of contacts, which includes contacts for the Arizona Department of Water Resources (A.D.W.R.), the Central Arizona Water Conservation District (C.A.W.C.D.), and Arizona Governor Douglas A. Ducey, were passed out to those in attendance.

Mohave County Supervisor Lois Wakimoto informed the crowd of an upcoming Mohave Valley Irrigation and Drainage District Meeting being held at an undetermined location at 4:00pm MST on Thursday, January 4th, 2018.

When a location for the Mohave Valley Irrigation and Drainage District Meeting is decided, the public and news media will be notified about the meeting location.

After the town hall meeting, ZachNews talked with Mohave County Supervisor Lois Wakimoto about the proposed sale and water transfer as well as how this will affect people in Needles, California and what’s next in the process.

The proposed sale and water transfer has already been met with opposition from Bullhead City and Lake Havasu City as well as from Mohave County Supervisors; all recently have passed resolutions objecting to the acquisition of water rights by Central Arizona Project and any movement of water outside the district.

A town hall meeting regarding Central Arizona Project water rights and transfer will be held at 5:30pm MST on Tuesday, December 12th, 2017 at the Mohave Valley Fire Department Station 81, located at 1451 Willow Drive, in Mohave Valley, Arizona.

According to Mohave County Supervisor Lois Wakimoto, the proposed sale is to the rights to nearly 14,000 acre feet of water from farms in the Mohave Valley, Arizona to be use in the Phoenix, Arizona and Tucson, Arizona areas.

In 1989, the Mohave Valley Irrigation and Drainage District passed a resolution and revised the resolution in 2008 prohibiting the transfer of contracted water outside Mohave Valley Irrigation and Drainage District boundaries, but that resolution could change if the Central Arizona Project board votes to change it.

In September 2017, the Central Arizona Project’s governing board, the Central Arizona Water Conservation District, approved the purchasing of 7 farms in the Mohave Valley, Arizona for $34 million and their associated water rights for the purpose of securing rights to water from the Colorado River and to implement a rotational fallowing program to generate a water supply for Central Arizona Project Groundwater Replenishment District.

The Central Arizona Project is attempting to close the deal by mid February 2018.

The Bullhead City, Lake Havasu City and the Mohave County Board of Supervisors all have passed resolutions objecting to the acquisition of water rights by Central Arizona Water Conservation District and any movement of the water outside the district.

The community is urged to attend this town hall meeting to learn more about the proposed sale or to address any concerns or issues regarding the water transfer or water rights.
